STATE-LEVEL REGULATORY PRESSURES Mount
Unlike most federal regulatory changes, state-level regulations
appear much more likely to impact equipment finance firms over the near term. The dizzying array of regulations at the state level ranges from usury laws to licensing requirements and even to the
definition of a “true lease.” ELFA members have expressed concerns about overlaps and contradictions between and among state regulations that may require redundant investments in technology,
software, and training. Further, there is a real worry how quickly some of these new or proposed state-level regulations could move from proposal to fully enacted
policy.

concerning specific commercial financing disclosure laws that are slated to take effect in 2022 in New York and California.
