Participation Rules & Code of Conduct For All ELFA Online Communities

These online communities were created for you, the members.  We encourage you to participate.  It is only through active use that an online community will evolve. The communities are "self-moderated" - you are responsible for what you post.  It is a free, member service to employees of all ELFA member companies. Participation in any ELFA online community is also a privilege. By joining and participating in a community, subscribers agree to comply with the following rules. Violation of these rules may result in revocation of participation privileges.

Participation in ELFA’s online communities is subject to the express understanding that communication within the group is for informational purposes only and does not constitute the rendering of legal, financial, or other professional advice or opinions by ELFA or by the participants in this community.  Moreover, the posting and delivery of information in this group does not create or constitute a client relationship between you as a subscriber and ELFA or any of the participants in this community.

The poster is entirely responsible for the content of a posting. ELFA does not exert editorial control over materials posted in any online community. However, if an inappropriate post or comment is brought to ELFA's attention, ELFA reserves the right to take all appropriate action. It is the responsibility of all subscribers, and not the ELFA, to comply with antitrust laws, intellectual property laws, securities laws, and all other applicable laws and regulations when participating in any ELFA online community.

Subscribers will not post or respond to messages which encourage or facilitate agreements or other conduct which may violate the antitrust laws, such as agreements with respect to prices or interest rates; profit margins; salaries; boycotts of suppliers, customers or competitors; market shares or division of markets; allocation of customer; or restrictions on advertising, the products or services that companies may provide or other competitive practices. ELFA has a long-standing antitrust compliance program, and participation in any ELFA online community is fully subject to that program.

Subscribers also will not post any information that infringes on any other person's or entity's intellectual property rights. By posting material, you represent and warrant that you are either the owner of the copyright in the material or have received permission from the copyright owner to post such materials. You further represent and warrant that the material is not a trade secret of another person or entity and that you are not subject to any other obligation of confidentiality with respect to the material. By posting materials, you hereby grant the Equipment Leasing and Finance Association, its affiliates, successors, and assigns, and the other users of this community a non-exclusive, worldwide, royalty-free license to reproduce, distribute and display the material and to create derivative works therefrom and to otherwise use information from the material.

ELFA’s online communities should not be used as a forum for sales, marketing, advertising or promotional messages. They should not be used as a means of offering to buy or sell equipment, lease-related transactions or any other property, transaction or interest. Subscribers will not post defamatory, abusive, obscene, threatening, offensive or illegal materials. Such activity is inappropriate, may violate applicable law, and may result in the loss of participation privileges. Subscribers posting defamatory, illegal or otherwise inappropriate messages may be blocked from the group. In addition, the online communities are not a place for ELFA members to provide reviews of other member companies and/or their products.

As is the case with all ELFA online communities, comments posted are not edited by ELFA. Messages posted can range from basic concepts to specific questions about industry issues. Subscribers should ensure comments are fact-based as ELFA will not edit communications.  ELFA is not responsible for any material posted on this site by others. ELFA specifically disclaims any and all liability for any claims or damages resulting from any information or materials posted on any ELFA online community.

Neither ELFA nor the participants in this group certifies or warrants the accuracy or completeness of the views and information contained within them. Subscribers are advised to consult with their tax, legal, accounting, and other experts before instituting actions based on comments posted by participants in the online community.

Finally, you agree to defend and hold harmless the Equipment Leasing and Finance Association, its affiliates, successors, agents and assigns, and the other users of these online communities against any claims, demands, or causes of actions resulting from your posting of the material and to indemnify the Equipment Leasing and Finance Association, its affiliates, successors, and assigns, and the other users of these communities against any and all claims, damages, liabilities, costs and fees (including reasonable attorney’s fees) resulting from their reproduction, distribution, display, creation of derivative works, or other use of the materials and the information contained therein.
